Terms of Service

1. Agreement to these terms

NyanReader ("NyanReader", the "app", "we", "us") is operated by Smile Chamber, a sole proprietorship based in British Columbia, Canada. These Terms of Service (the "Terms") govern your access to and use of the NyanReader applications and related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service does

NyanReader is a reading and translation tool. It displays comic and manga files ("CBZ" and similar formats) that you provide from your own device, and offers an optional AI-powered translation feature that detects text on a page and returns a translated version.

NyanReader does not provide, sell, or distribute manga, manhwa, comics, or any other reading content. You are solely responsible for the files you choose to open, import, or translate with the Service.

3. Your account

• You may create an account using a valid email address. You are responsible for keeping access to that email secure.
• You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to create an account.
• One person may not maintain multiple accounts to abuse free credits or promotions.
• You are responsible for all activity that occurs under your account.

4. Credits and payment

• Translation is powered by "credits." One credit translates one page.
• Credits are sold in bundles. Current pricing is shown in the app and on our website and may change over time.
• New accounts may receive a one-time allocation of free credits. Free credits have no cash value.
• Credits do not expire, but they are tied to your account and are not transferable.
• Prices are shown exclusive of tax. Applicable sales tax is calculated and added at checkout based on your location.
• Purchases made on the web are processed by Stripe. Purchases made through the Google Play Store or Apple App Store are processed by, and subject to the terms of, those stores.
• Credits are non-refundable once purchased, except where a refund is required by applicable law or by the policies of the app store through which you purchased. App store purchases are subject to the refund process of that store.
• We may correct pricing errors and may adjust, add, or discontinue credit bundles at any time. Changes do not affect credits already purchased.

5. Acceptable use

You agree that you will not:

• Use the Service with content you do not have the legal right to possess or process;
• Use the Service to infringe the intellectual property rights of others;
• Use the Service for any unlawful purpose, or to process content that is unlawful in your jurisdiction;
• Attempt to bypass, disable, or interfere with credit metering, payment, authentication, or other technical measures of the Service;
• Reverse engineer, decompile, or attempt to extract the source code or any embedded keys or prompts of the Service, except to the extent this restriction is prohibited by applicable law;
• Resell, sublicense, or commercially redistribute the Service or access to it;
• Use automated means to abuse free credits, promotions, or the translation service.

You are solely responsible for the legality of the files you use with the Service in your jurisdiction.

6. Your content

You retain all rights you have in the files you use with the Service. The Service operates on files stored on your own device; we do not upload, store, or distribute your files.

When you use the translation feature, the text detected on a page is transmitted to our translation provider solely to produce a translation and return it to you. You grant us the limited right to process that text for this purpose. See our Privacy Policy for details.

7. Our intellectual property

The NyanReader applications, website, branding, and underlying software are owned by Smile Chamber and are protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to the software except the limited, revocable, non-transferable right to use the Service in accordance with these Terms.

8. Third-party services

The Service relies on third-party providers, including but not limited to Supabase (authentication and database), Stripe (web payments), RevenueCat and the Apple App Store and Google Play Store (mobile payments), and xAI (translation processing). Your use of the Service may also be subject to the terms of those providers.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

AI translation is inherently imperfect. We do not warrant that translations will be accurate, complete, or fit for any particular purpose. You are responsible for reviewing translated output before relying on it.

10. Limitation of liability

To the fullest extent permitted by law, Smile Chamber will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for credits in the twelve months before the claim arose.

Some jurisdictions do not allow certain limitations of liability, in which case the above applies to the maximum extent permitted.

11. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that creates legal risk or harm. You may stop using the Service and request deletion of your account at any time. Credits are forfeited on account termination and are not refunded except as required by law.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law principles. The courts located in British Columbia will have jurisdiction over any dispute, subject to any non-waivable rights you have as a consumer in your place of residence.
