Terms of Service

1. Agreement to these terms

NyanReader ("NyanReader", the "app", "we", "us") is operated by Smile Chamber, a sole proprietorship based in British Columbia, Canada. These Terms of Service (the "Terms") govern your access to and use of the NyanReader applications and related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service does

NyanReader is a reading and translation tool. It displays comic and manga files ("CBZ" and similar formats) that you provide from your own device, and offers an optional AI-powered translation feature that detects text on a page and returns a translated version.

NyanReader does not provide, sell, or distribute manga, manhwa, comics, or any other reading content. You are solely responsible for the files you choose to open, import, or translate with the Service.

You retain all rights you have in the files you use with the Service. The Service operates on files stored on your own device; we do not upload, store, or distribute your files.

When you use the translation feature, the text detected on a page is transmitted to our translation provider solely to produce a translation and return it to you. You grant us the limited right to process that text for this purpose. See our Privacy Policy for details.

7. Our intellectual property

The NyanReader applications, website, branding, and underlying software are owned by Smile Chamber and are protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to the software except the limited, revocable, non-transferable right to use the Service in accordance with these Terms.

8. Third-party services

The Service relies on third-party providers, including but not limited to Supabase (authentication and database), Stripe (web payments), RevenueCat and the Apple App Store and Google Play Store (mobile payments), and xAI (translation processing). Your use of the Service may also be subject to the terms of those providers.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

AI translation is inherently imperfect. We do not warrant that translations will be accurate, complete, or fit for any particular purpose. You are responsible for reviewing translated output before relying on it.

10. Limitation of liability

To the fullest extent permitted by law, Smile Chamber will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for credits in the twelve months before the claim arose.

Some jurisdictions do not allow certain limitations of liability, in which case the above applies to the maximum extent permitted.

11. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that creates legal risk or harm. You may stop using the Service and request deletion of your account at any time. Credits are forfeited on account termination and are not refunded except as required by law.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law principles. The courts located in British Columbia will have jurisdiction over any dispute, subject to any non-waivable rights you have as a consumer in your place of residence.
